1. Agreement Between user and VIP
a. Your use of this website is conditional on your acceptance of the terms and conditions contained herein.
b. Your use of this website constitutes your agreement to all such terms and conditions.
c. All content on this website is owned by VIP Mortgage Solutions and you agree not to copy or download any content without our authority.
2. Modification of these terms of use
VIP reserves the right to change the terms and conditions at its discretion at any time without notice to you, including but not limited to the charges associated with the use of this Site.
3. Services Offered
a. We are finance and mortgage brokers for various private and retail lenders. Our services do not include advice on the legal or financial implications of entering into credit arrangements or particular finance products. We recommend that you seek independent legal and financial advice.
b. You acknowledge and agree :
• to engage us to introduce financial products on your behalf for you which is best tailored to your needs based on information you have provided to us.
• The information you have provided to us is true and correct and that we will rely upon such information when arranging your financial product.
• In proceeding with our services, you expressly agree and represent to us that you have relied upon your own independent inquiries and advice in relation to the financial and legal implications of entering into this agreement or a loan contract.
• You will release, indemnify and hold us harmless from all and any loss, damage, cost or injury suffered by you, and with respect to any claim, proceeding, or action which does or might arise out or in relation to this agreement or the services provided to you by us.
• The terms of the loan you are seeking are indicative only and may be subject to change. Please refer to the loan contract given to you by the lender for the full terms and conditions of the loan.
• You are able to make the quoted repayments over the quoted term without undue hardship.
• If your loan is a Low Doc loan then the income being declared is true and correct.
4. Our panel of lenders
a. We have entered into arrangements with our panel of lenders which allows us to obtain credit for you from these lenders subject to you meeting the lender’s credit criteria.
b. Our panel of lenders may not necessarily represent all the lenders who are able to offer credit of the nature that you seek.
c. We may consider entering into agreements with lenders that are not part of our standard panel provided they will agree to deal with us as your representative and consent to our accreditation.
5. Fees payable by you
No fees are payable by you to us except where your actions trigger a claw back of any commissions paid to us by the lender. All fees chargeable by us will be disclosed to you up front.
6. Privacy disclosure statement and consent
a. All information provided by you will be used for the purpose of providing you with the lending solutions most appropriate to your needs and from time to time providing you with offers or information of other related services we or a third party may be able to provide you with, unless you tell us not to use your personal information for this purpose in writing.
b. The types of organisations we may disclose your information to include:
• Lenders;
• Mortgage insurers;
• Valuers;
• Our Aggregator;
• Credit reporting agencies;
• Other mortgage intermediaries;
• Government organisations as required by law;
• Other organisations which assist us (such as printers, mailing houses, lawyers, debt collectors and accountants);
• Your appointed advisors (such as your solicitor, conveyancer, accountant, real estate agent or any persons acting on your behalf).
c. Unless you tell us otherwise, we may disclose your information to any person who is acting on your behalf, with your legal authority or who is purporting to act with your legal authority.
d. In addition, we may disclose your personal information to any other organisations that you may wish to, or has acquired, an interest in your loan or in our business.
e. We may also contact various organisations that may have information about you and your associated entities so as to obtain the information for the purpose of providing our services to you. The types of organisations we may collect your information from include:
• Employers;
• Accountants;
• Solicitors or Conveyancers;
• Credit reporting agencies; or
• any other organisation that may have information about you which we require to provide our services.
f. You authorise these organisations to release to us any information we may request. You appoint VIP Mortgage Solutions as your agent in obtaining a copy of your consumer & commercial credit information for both yourself as an individual and any companies, trusts, trading names, registered names or related entities of which you are either an owner, trustee or director. This authority only applies to enquiries made by VIP Mortgage Solutions in connection with your application, or proposed application.
You agree that we may collect and use your personal information as specified above.
7. No Representations or Warranty
a. We reserve the right to modify the information presented on this web site at any time without notice.
b. While we make all reasonable efforts to ensure that all material on this site is correct, we cannot guarantee the accuracy and we do not assume any responsibility for the accuracy, completeness, or authenticity of any information contained on this site.
